Recoverable Damages in Wrongful Death Cases
Wrongful death can happen suddenly for a variety of reasons, including car accidents and pedestrian accidents. If you lost a close relative in an accident caused by another person’s negligence, you may be able to seek economic and non-economic damages from the other party. This may include:
- End-of-life medical expenses: Surviving family members can claim reimbursement for medical care the decedent received before dying from an accident-related injury. This type of financial loss is supported by medical bills and invoices.
- Funeral Services Costs: Funeral and burial services can be expensive. Hospice support reimbursement does not compensate close relatives for loss. However, it may help alleviate financial hardship for surviving family members.
- Loss of Support: If the deceased was the primary breadwinner for the family and lost financial support as a result of their death, surviving family members may seek compensation for the loss. Damages for loss of financial support depend on factors such as the deceased’s age, occupation, education, health and life expectancy.
- Bereavement: When a close relative dies unexpectedly, there is grief, depression, fear, anger, and emotional distress. Family photos, statements from survivors, and any other evidence of the loss of a meaningful relationship with the deceased are evidence of loss of companionship with the deceased.
